The Minister for Housing, Planning and Consumer Affairs, Felix Ellis MP, has tabled the Land Use Planning and Approvals (Sensitive Disclosures) Bill 2025 in the House of Assembly.

The Bill amends section 60BA of the Land Use Planning and Approvals Act 1993 (LUPAA) to enable sensitive matters requests to be made for those major projects that have not been determined, but were declared prior to section 60BA coming into effect on 17 May 2023. There is only one major project which is affected by this Bill: the North East Wind Major Project.

The Bill ensures that the remainder of the assessment process for the North East Wind Major Project can be conducted in a manner which conceals sensitive Aboriginal cultural information from viewing by the general public.

Targeted consultation on the draft Bill was conducted with those persons directly affected by the outcomes of the Bill.

The Bill will be debated in Parliament shortly and if approved by both houses of parliament, the Bill will ensure that Aboriginal culture is respected during the major projects assessment process for the North East Wind Major Project.
