This could range from:

  • Having to stop the offending use/development
  • Remedying any change or damage
  • Removing or demolishing illegal structures
  • Cancellation of permit.

If you persist, the Council may take proceedings to the Magistrates Court, which may result in a fine. If the court finds you guilty, you will also have to pay the legal costs.

You can appeal against an enforcement notice to TASCAT, within 14 days of receiving it.

Councils, individuals or other relevant authorities may also enforce planning or building controls by seeking an injunction in the Supreme Court preventing unlawful conduct.
